"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.

The case stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to face alien smuggling allegations, he was detained in federal custody.

In her order, the court pointed out that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
